Ukrainian community in a European television - Journal Mediasat

Dmitry Kotlyar, as a member of the working group on the development of the Law “On Television and Radio Broadcasting” spoke about the role of community broadcasting in Ukraine in the concept of a new edition of the Law:

– «The state promotes the development of community broadcasters as the” third sector “in addition to broadcasting commercial and community television and radio broadcasting (public / communal before his transformation into a community-based organization of broadcasting).

– This includes:
a license outside the auction;
inclusion in the regional / local digital multiplex
rates for digital multiplex service provider;
possibility of budget financing ».

In the new draft of the Law refers to the following provisions:
-« Promotion of community broadcasting – one of the the basic principles of the state policy in the field of audio-visual services, which determines the direction of public authorities, including the National Council
.

– Community Broadcasting is to provide audiovisual services by broadcasting local or regional category of broadcasting which is carried out in order to meet the informational, cultural, educational, linguistic needs of territorial communities (communities),
minority and is not intended to make a profit.

– The subject of the provision of audiovisual services in the form of community broadcasting can be a Non-Enterprise company or other entity that does not have to make a profit (including associations and based on these entities).

– Community-based broadcasting is carried out on the basis of a license issued in compliance with this Act.

– General method of licensing broadcasters – the auction. Licensing of community broadcasting – a competition without paying a license fee. ” Have not defined the criteria for licensing competition for community broadcasting. Also open to question his inclusion TOS.

– Software community broadcasting
must meet the following requirements:
1) own product must be at least 50% of the total broadcasting;
2) The transfer of entertainment genre should not be more than 20% of total broadcast;
3) at least 2 hours of daily broadcasting time intervals
between 06.00 and 23.00 should be news programs of local or regional significance.

– National Council defines the criteria of the transmission to the entertainment or informational genre.

– The programs of community broadcasting are prohibited from engaging in political campaigning ».
