Online store sold a faulty TV and disappeared from the network – DELFI.ee

The buyer acquired in Pult24 32- online store inch TV Philips, paying him 270 euros and another 5.90 euros for shipping. As a result, television had to pass three times in warranty repairs, and on 16 December OÜ Simson ServiceNet EE issued a claim report, according to which the TV had manufacturing defects. The defective TV remained at Simson ServiceNet EE. The buyer was trying to contact the seller via telephone and the Internet, but have not received feedback. Seller is unable to meet its obligations, then the client has decided to terminate the contract of sale and asked the seller to return 276.90 euros.

Since the seller does not reply to the statement of the buyer, the consumer disputes the Commission proceeded only presented data buyer. The Commission examined the available materials of the case and decided that the requirement of the client to terminate the contract need to meet.

According to the law, grounds for termination of the contract of sale may be the failure of the seller to replace the goods or failure to do so within a reasonable time, so demand the customer to terminate the contract justified and should meet. Upon termination of the contract the parties have to return received by them, while the seller must return a 270 euros for television and 5.90 euros for shipping, since it wrongly refused to comply with the terms of the contract. The client has returned the TV via OÜ Simson ServiceNet EE.

The seller must in writing notify the Consumer Protection Board on the implementation of the decision within 30 days from the day following the publication of the decision on the website of the Department or after treatment in the county court on that same case.
