As follows from the case, the buyer had bought in the store TV LG worth 76.364 thousand. rub. In operation, the TV no longer be switched on and react to the remote control.
The buyer appealed to the store with a claim, which refuses to buy the goods and requested a refund on the TV. However, the claim was left without satisfaction shop, so the buyer was forced to turn to the court.
According to expert opinion the motherboard and the remote control is inoperable as a result of short-circuit power. Identified defects are manufacturing as defects operation on the external and internal parts of the TV is not detected, that is, violations of conditions not found.
As the actions of the store there was a violation of consumer rights, the court granted the plaintiff’s claims to recover from the store penalties, fines, as well as compensation for moral damage. In total, the store is collected in favor of the plaintiff 138.935 thousand. Rub. TV buyer is obliged to return the store.
