A resident of the Belgorod region in June 2015 bought the store “Eldorado” TV for 378,000 rubles. Buying a home delivered to the new owner. Set the TV man decided a month later. When you turn on the device the image does not appear on it, and the screen become noticeable crack.

The shop refused to replace the product. This was the reason for going to court.

At the hearing the defendant’s representative explained his position that the damage could appear on the TV due to incorrect installation or relocation. Could be an indirect cause of the large dimensions of the device – a diagonal of 145 cm and weight of 40 kg.

The court agreed with the arguments of the plaintiff. Decision of court with the defendant should be recovered 378,000 rubles as the value of damaged goods, 124,770 rubles as a penalty for delay in meeting the requirements of the buyer, 5,000 rubles in compensation for moral damages, 253 900 rubles – the penalty for failure to comply with voluntary requirements of the consumer, 6,300 rubles – as expenses on the services of an expert, the press service of the Belgorod District Court.

So the defendant by the court is obliged to pay 970 rubles to the consumer 767.
